Terms of Service

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal authority to enter into these Terms, whether on your own behalf or on behalf of an organization.

2. Description of Service

PixelPush.in allows users to upload a design image and compare it against a live website URL to identify visual differences ("comparisons"), optionally including AI-generated plain-English analysis of flagged differences. Features, usage limits, and report retention windows vary by subscription plan as described on our Pricing page.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, though we will make reasonable efforts to notify users of material changes affecting paid plans.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate and complete information when creating an account and keep it up to date.
• You are responsible for notifying us promptly of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Submit a live URL for comparison unless you own the website, are authorized to test it (e.g., as a developer, freelancer, or agency working on the site), or otherwise have a legal right to access and screenshot it.
• Upload content that is unlawful, infringing, harmful, or that you do not have the right to upload.
• Attempt to circumvent usage limits, rate limits, or plan restrictions.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.
• Use automated means (bots, scripts) to access the Service outside of any officially provided API, or in a way that imposes an unreasonable load on our infrastructure.
• Use the Service to violate any applicable law or regulation, or the rights of any third party.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate access for any account found violating this section.

5. Your Content

• Ownership: You retain ownership of the design images and other content you upload ("Your Content"). We do not claim ownership over Your Content.
• License to us: By uploading Your Content, you grant us a limited, non-exclusive, worldwide license to host, process, and display Your Content solely for the purpose of providing the Service to you (e.g., generating your comparison report, including sending relevant portions to our AI analysis provider as described in our Privacy Policy).
• Your responsibility: You are solely responsible for Your Content and represent that you have all necessary rights to upload it and to request comparisons against the live URLs you submit.
• Reports: Comparison reports and diff images we generate for you are provided for your use in accordance with your plan, subject to the retention windows described in our Privacy Policy.

6. Subscriptions, Billing, and Cancellation

• Plans: The Service offers a free plan and paid subscription plans ("Freelancer" and "Agency"), billed monthly or annually as selected at checkout. Current pricing is listed on our Pricing page and is subject to change with notice for future billing cycles.
• Payment processing: All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service in addition to these Terms. We do not store your full payment card information.
• Automatic renewal: Paid subscriptions renew automatically at the end of each billing cycle (monthly or annual, as selected) unless canceled before the renewal date.
• Cancellation: You may cancel your subscription at any time through the billing management portal accessible from your account. Cancellation takes effect at the end of your current billing period; you will retain access to paid features until that time.
• Refunds: No refunds, but cancel anytime — you'll retain access through the end of your current billing period
• Plan changes: Upgrades and downgrades take effect according to Stripe's standard proration rules unless otherwise stated at the time of the change.
• Failed payments: If a payment fails, we may suspend access to paid features until payment is resolved, and your plan may automatically revert to the Free tier after a reasonable grace period.

7. Usage Limits

Each plan includes a defined number of monthly comparisons, AI-powered verdicts, and a report retention window, as described on our Pricing page. We reserve the right to enforce these limits technically (e.g., blocking additional comparisons once a monthly limit is reached) and to adjust limits with reasonable notice.

8. Intellectual Property

The Service, including its design, software, branding, and underlying technology, is owned by PixelPush.in and protected by applicable intellectual property laws. These Terms do not grant you any right to use our name, trademarks, or branding without prior written permission.

9. Third-Party Services

The Service integrates with third-party providers, including Stripe (payments), Supabase (authentication and storage), Vercel (hosting), Anthropic (AI-powered analysis), and Google Analytics (analytics). Your use of the Service is also subject to the applicable terms of these providers where relevant. We are not responsible for the acts or omissions of third-party providers.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted, error-free, or available at all times.
• AI-generated verdicts will be accurate or complete. AI-powered analysis is provided as a helpful aid, not a guarantee — you should independently verify any flagged differences before relying on them for business-critical decisions.
• Comparisons will catch every visual difference between a design and a live site.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELPUSH.IN AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless PixelPush.in and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the Service, or Your Content, including any claim that you lacked authorization to submit a given live URL for comparison.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ceases immediately, though certain provisions of these Terms (e.g., limitation of liability, indemnification) will survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last Updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated via email or a prominent notice where required by law.
